Melatonin remains OTC

Melatonin Products may still be sold freely.

That’s what the court in The Hague decided this week, after proceedings brought by the trade organization Nature and Health Products Netherlands (NPN) at the Health Care Inspectorate (IGZ).

Last year, the court ruled in Arnhem in an emergency procedure initiated by the NPN which could be products of 0.3 mg to 5 mg in free sale. The occasion was to consider the decision of the Inspectorate of melatonin as a unit dosage of 0.3 mg is a prescription medicine.

The Hague court is now saying that Healthcare Inspectorate only in individual cases may stop the free sale of melatonin. Inspectorate must in each case whether the Medicines Act has been violated with a melatonin product.

NPN is the trade association for manufacturers, raw material suppliers, wholesalers, importers and distributors of dietary supplements such as vitamins and herbal preparations
